Filing an Eviction Lawsuit against a Tenant


In what cases can the landlord sue the tenant for eviction?
According to the principles contained in the Turkish Law on Debts, the landlord must have a legitimate reason to evict his tenant from his home. If a term is specified in the lease agreement in explicit or implicit form, the lease agreement ends spontaneously at the end of this period.

In
lease agreements of indefinite duration, each of the parties may terminate the contract by complying with the statutory termination periods and notice periods, unless a longer notice period of termination or another termination period has been agreed. So, in what cases can the landlord evict the tenant before the statutory termination period of the contract has expired?

Need for habitation: This clause applies if the landlord, spouse or children need to use the rental property as a residence. A lawsuit can be filed 1 month after the end of the lease agreement.

Workplace need: This clause applies if the landlord is going to use the rental property as a workplace for professional or artistic purposes. A lawsuit can be filed within 1 month after the end of the lease.

Essential repair, reconstruction or zoning, restoration, alteration: If the landlord wants to have the property rebuilt or to carry out large-scale repairs, extensions or alterations to the interior, he can therefore vacate the house. A lawsuit can be filed within 1 month after the end of the lease agreement.

Business or
habitation needs of the person who reacquires: The person who buys or owns a real estate on lease may wish to use it as a home or workplace for himself, his or her spouse or children. In this case, a notice is issued to the tenant within 1 month from the date of ownership of the property, 6 months after the date of notification, a lawsuit must be filed within 1 month.

Non-payment of rent: If the tenant does not pay the rent regularly, the landlord can first withdraw 2 valid notices within 1 year and then file a lawsuit. If the notice has not been withdrawn, the expiration date of the lease can be waited and a direct lawsuit can also be filed within 1 month.

If the tenant or his spouse has housing that can live within the same municipal boundaries: This gives the landlord the right to be able to file for eviction at any time without warning.
