Tenant Rights


In real estate leasing transactions, the legal rights of the owner and the tenant who signed the lease agreement are guaranteed by the Turkish Debts Law No. 6098. In this direction, the rights of tenants are determined as

follows. A

lease can be defined as a contract in which the landlord agrees to transfer to the tenant the use of the leased property or the use of the property in addition to the use, and in this case the tenant agrees to pay in full the predetermined rental price. The owner of the property and the tenant who signed this contract must fully fulfill the clauses contained in the lease agreement.

As is known, a lease can be made for a specific and non-specific period. The lease, which expires without any notice after the agreed period has elapsed, is for a fixed period; other leases are considered to have been concluded for a non-specific period of time. So, what are the tenant's rights during the rental period?

— The landlord cannot evict the tenant from the house before the lease expires. In addition, unless the landlord has issued a notice to his tenant 1 month before the end of the contract, the contract is renewed by itself and has the status of an indefinite contract.

— The tenant may ask the lessor to remove the burden from the lessee in a timely manner; if the disgrace is not remedied within this time, the tenant may pay the rent to the lessor's account and deduct the resulting amount from the rental price or request that the lessee be replaced with a free equivalent.

— The tenant may ask the lessor for the removal of the damages or for a reduction in the rental price in proportion to the dishonor, or the elimination of its loss.

— The tenant may, in whole or in part, lease the lessee to another person, as well as transfer the right of use to someone else, provided that it does not cause a change that would harm the lessor.

— If the tenant does not get enough use of the house he is renting, if the house has problems, he can leave the house without waiting for the expiration of the term of the contract by stating his legitimate reason.

— The landlord pays the price for renovations related to the parts of the house that are fixtures. However, the tenant is responsible for any changes that he will make in accordance with his own taste

— The tenant does not have much responsibility in the management of the apartment. In order to become an apartment manager, the landlord needs to issue a power of attorney to him.

— The tenant has the right to receive his deposit as long as he does not damage the dwelling in question when leaving the house, but leaves the house as he bought it.

In 2015, the rights of tenants were secured by the Turkish Debts Law within the scope of the articles listed above.
