Obligation to employ janitors in apartments


There is no law regarding the obligation to have a janitor in apartments. The janitorial profession has become a line of business in parallel with the increasing number of apartments and buildings. Some apartment and site managers employ arbitrary janitors and pay low fees. This is where the law comes into play. If you want to work as a building attendant as a manager, you can not make a payment below the minimum wage, while covering all the benefits.

The

obligation of a janitor's apartment in apartments is specified by the Ministry of Environment and Urbanism “REGULATION ON MAKING CHANGES TO THE PLANNED AREAS TYPE ZONING REGULATION” published by the Ministry of Environment and Urbanism.

According to Article 34 of the Regulation;

a) It is mandatory to build a janitor's apartment for buildings with or without heating for residential use, with a number of independent sections exceeding 30 and using solid fuel. This provision also applies to parcels in which there are more than 30 buildings and the total number of independent sections is more than 30, but if the number of independent sections exceeds 75, a second caretaker's apartment is made. Also, on plots with multiple structures, a separate janitor's apartment is necessarily made for each building with more than 60 independent partitions.

b) For residential buildings using fuel oil or natural gas as fuel, it is mandatory to make one, if the number of independent sections is more than 50, and 2 janitor's apartments if there are more than 150. An additional janitor's apartment is made for every 150 additional apartments. The lower level of the door and window openings of the janitor apartments to be arranged in the buildings remaining in areas at risk of flooding must be at least 1.50 m above the calculated crest elevation of the creek.

c) In the Siraevler layout, there is no obligation to build a janitor's apartment in parcels with more than 1 detached residential buildings with a single independent section in separate, twin niches.
