Obligation to Hire Occupational Safety Specialist and Workplace Physician in Apartments


In the Occupational Health and Safety Law No.

6331 on Occupational Health and Safety in Apartments
, workplaces were divided into three classes as low-hazard, dangerous and very dangerous, and the obligation was gradually made to employ occupational safety specialists, workplace physicians and other health personnel according to the hazard classes of workplaces.

By Law No. 6495, the obligations to employ occupational safety specialists and workplace physicians were postponed until 01.07.2016 for public institutions and workplaces with fewer than 50 employees and located in the least hazardous class, and then this date was extended to 01.07.2017.

In apartments that employ at least one attendant (janitor) under this law, an occupational safety specialist and a workplace physician will employ or purchase these services.

How to Buy Occupational Health and Safety Service.

They can employ an apartment or site management occupational safety specialist and physician on their own premises, or they can fulfill the obligation to employ occupational safety and workplace physicians by purchasing services from common health and safety units authorized by the General Directorate of Occupational Health and Safety of the Ministry of Labor and Social Security.

How much punishment is imposed on those who do not work?

According to the Occupational Health and Safety Law No. 6331, an administrative fine of 6,511.00 TL will be imposed for each month, separately for occupational safety specialist and workplace physician who have fewer than 10 employees and are not employed in a workplace of least hazardous class.

If the workplace physician and occupational safety specialist are not employed for one month in the apartment where a janitor works, an administrative fine of 13,022 TL will be imposed for that month when he does not work in the apartment.

An administrative fine of 156,264 TL will be imposed on the apartment building that does not employ a workplace physician and occupational safety specialist for one year.


It is worth recalling once again; This law entered into force on 01.07.2016, but was extended until 01.07.2017. After 01.07.2017, the obligation to employ occupational safety specialists and workplace physicians will officially begin.
