What is a building risk analysis?
Anyone who employs a janitor, gardener or security guard in any apartment building will be subject to risk assessment from 1 January 2013 and will be required to undergo a risk assessment.
In order for apartments to be included in the risk assessment, it is enough to have only one employee. Apartments that do not employ workers (managers, janitors, etc.) do not have to carry out risk assessments
.In the relevant legislation, risk assessment is defined as the necessary studies to be carried out in order to identify hazards that exist or may come from outside the workplace, the factors that lead to the transformation of these hazards into risks and to evaluate the risks arising from hazards and to decide on control measures.
Inapartment buildings, owners of floors are considered employers. Obligations of employers are indicated below;
— The employer must carry out or have a risk assessment in terms of occupational health and safety in order to ensure, maintain and improve the health and safety of the working environment and employees.
-The fact that the risk assessment has been carried out does not eliminate the employer's obligation to ensure occupational health and safety at the workplace.
— The employer is obliged to provide all the information and documents they need regarding the risk assessment to the person or persons assigned to the risk assessment work.
— The employer meets all the necessary needs such as tools, equipment, space and time in order to perform the duties of the person or persons assigned in the risk assessment work, and cannot restrict their rights and powers due to the performance of their duties.
