About Building Attendant (Janitor) Severance Compensation


We would like to give some information about the severance compensation of the Building Attendant (Janitor), which is often a problem in apartments by our users.



What is Severance Compensation?
The
money paid collectively by the workplace to a worker who is terminated after working for a certain period of time or who is in need of retirement due to retirement, according to the time he has worked.

When Is Severance Compensation Deserved?
The building attendant must have worked in the building for at least 1 (one) year to be eligible for seniority compensation.

How is Severance Compensation Calculated?
When the
work of the Building Clerk (Janitor) is terminated or in the event of retirement, the severance pay that he deserves is found multiplied by the year of his last gross salary, multiplied by the year in which he worked.

Who Pays Severance Compensation?
The wages and expenses of the building attendant (janitor) during the working months are collected from the tenant within the fee. However, the severance pay is received from the Condominium Owner, as stated in the KMK (Law on Condominium).

The
provisions of Article 18 of the KMK relating to the debts of the owners of the floors shall also apply to tenants and owners of the right of residence in independent sections or to those who continuously benefit from such sections; those who fail to fulfill these obligations shall be jointly and severally liable together with the owners of the floors. According to
Article 22 of the KMK, “Those who continuously benefit from the expenses and advance debt and compensation for arrears due to the share of the floor owner in accordance with Article 20, are jointly and severally liable on the basis of a lease agreement, right of residence (subsistence) or any other reason in one of the independent sections. However, the tenant's liability is limited to the amount of rent that he is obliged to pay, the payment he makes is deducted from the rent debt”.

The
public reputation of this issue has always been controversial. Floor owners often do not want to pay severance pay and argue that it should be collected from the tenant. However, as it is written in the article above, the tenant writes that he is responsible for the rent debt paid by the apartment debt, and from this amount paid he is deducted from the rent debt. Therefore, the floor maliki is responsible for the severance pay.

However, today, most apartment management collects monthly money along with dues as a compensation fund for employees, and these funds are also collected from tenants. The money accumulated in the employee compensation fund is used to pay severance pay when the time comes.
