Decision Book Approval Time and Attestation Obligation
According to the Law on Condominium Property, apartment managers are obliged to keep two books. These ledgers are the decision book and the business (income-expense) book.
Obligation of Attestation of Apartment Registers
In accordance with Article 32 of the Law on Condominium, certification of the apartment decision book is mandatory. The business (income-expense) ledger, on the other hand, does not have to be certified.
KMK Article 32 — Anagayrimenkul is governed by the board of apartment owners according to the decisions to be made in accordance with the contract, the management plan and the provisions of the law.
All apartment owners and their minor successors, administrators and supervisors are obliged to comply with the decisions of the board of floor owners.
Disputes arising between or between the owners of the floors due to the use or management of the parent real estate, or between them and the managers and the supervisors, or between the auditors and the managers, are resolved and decided upon by the meeting of the owners of the floors.
Decisions of the Board of Floor Owners shall be signed by all floor owners present at the meeting, indicating the reason for this discrepancy, by writing them in a notarized notebook, starting from (1) and each page bearing page numbers going in turn.
Further disputes on an issue are resolved on the basis of the basis if there is an earlier decision on the same issue in the decision book.
Attestation and Time of Attestation of Apartment Registers
The apartment manager must notarize the apartment decision book by the end of January each year. The approval process is to close the pages of the previous year and the pages that will be used in the new period are sealed by a notary.
Criminal Liability in Case of Non-Acknowledgement of Apartment Registers
In case of any inspection, the apartment management is fined if the apartment decision book is not approved and pays this penalty amount out of its own pocket.
Usually apartment managers approve the decision book once and use it until the book is finished. This is incorrect. Apartment decision books must be certified by a notary every year.
